Brechts vision of a more humane society changed with the rise of fascism (Silberman, 1993). Brecht focused on new representation. He was blacklisted out of 40 scripts he wrote, one was accepted for filming, and this was cut severely by Hollywood that Brecht withdrew it. Brechts commitments were leftist enough to provoke HUACs investigation in 1947 and the refusal of visas for travel to West Germany under US control (Kruger, 2004). Brecht also came into conflict with the Stalinist cultural bureaucracy. They forced him to make changes in several productions and even stopped two of them (Esslin, 1959). Brecht received support for his theatre in East Germany but he expressed private reservations about SED policy, especially after the workers uprising on 17 June 1953 challenged the partys claim to lead a â€Å"workers and peasants state† (Krug er, 2004). Brechts relation to the GDR regime remained contradictory. On the one hand, he said it would be better to have a bad socialism than to have none, he also disliked the dictatorship. When the Berlin workers uprising (1953) was repressed, he wrote a letter to the general secretary of the Communist Party in which he called for dialogue (Esslin, 1959). Only his last sentence backing the government was published. Hi call for dialogue, I believe, had two aims. Firstly, to reinstate peace amongst the campaigning people, as it seems unlikely Brecht would have spoken publicly against the GDR regime, despite his dissatisfaction with the scenario. Secondly, because of his pro-GDR regime status and his status as a GDR icon, his words would be more trusted by both parties. Brecht wanted audiences to use critical perspective to identify social ills and therefore effect change, having described his plays as a collective political meeting in which the audience is to participate actively (Brooker, 1994). For this purpose, Brecht employed the use of techniques that remind spectators the play is a representation of reality and not reality itself called the alienation effect (Esslin, 1959). The Constitutions First Amendment has been cited by experts as protection both the right of the teacher to academic freedom and right of the student to know. It has also at the same time been argued by the legal experts that there is a right that haves have to protest against materials or books which they consider will have a damaging affect on their children. Taylor, 1994). Thus, the teacher should have reported the incident for the safety of the student who was harassed knowing that the harassment was of grave nature. Failure on the part of the teacher to report is actionable (Vacca Bosher, 2008). Further in the case of Davis v. Monroe County Board of Education (1999) it was held by the high court that the official of public school may be held liable in a sexual harassment situation where it was a student on student in the case wherein the harassment is so pervasive and severe that victim students ability to learn is limited, where there was a knowledge of this harassment by the school officials, where there was deliberate indifference which was showed by the school officials and where there were no responsible steps that were taken for remedying such situation (Davis v. Monroe County Board of Education, 1999). This standard of deliberate indifference is a tool which subsequent court applies consistently. In the given case as well this standard would be made applicable for determining whether the teacher would be made liable (Mason Stephenson, 2012). There is no automatic liability of the teacher unless there is the fulfillment of the standards of deliberate in which case the teacher would be held to be liable. Further, the school district can also be held liable for violation of Title IX if there is the failure to take action that is reasonable against long-term and serious sexual harassment that is student to student which the school employee was aware of (Hudgins Vacca, 2012). Thus there has to be action taken against both the student and the teacher however it has to be kept in mind what the seriousness of the act was and what would be the most reasonable action that could be taken. 3. Brief Facts of the Case In this case, an eighth-grade student Jon, who, has had various discipline issues and has been diagnosed as emotionally disturbed threatened violence against a teacher. Issue What are the disciplinary options that are available? What are the legal implications in this case? Solution When there is harm or violence which is threatened by a student the administrator may implement any of options such as (i) removing the student immediately from the classroom the student who has threatened the injury, (ii) the student to be placed in a setting where his behavior can receive attention immediately, including, though not limited to the office of (a) the school principal, (b) the vice principal, (c) the assistant principal, (d) the psychologist of the school who has been licensed by any mental health professional's office or by the Teacher Standards and Practices Commissioner, and (e) the counselor before being allowed to return to the setting of a classroom, and (iii) the guardian of the student has to be informed promptly and no later than 24 hours of the incident regarding the behavior of the student and the action of the school (Fein, et al., 2002). In the case of Lovell v. Poway Unified School District (Lovell v. Poway Unified School District, 1996), where a suit had been brought by a student's parents called Sarah for removing the referral form from her file the Ninth Circuit Court upheld the action of the court and ruled that the communication made by Sarah was a true threat. It is an objective standard, according to the Ninth Circuit, which lays focus on the speaker by which alleged threats are judged. The test is that whether a person who is reasonable while making a statement can foresee that there could be an interpretation on the part of the listener as an expression that is serious for intending harm. The First Amendment does not protect true threats under the categories of expressions that are protected the Ninth Circuit Court further emphasized. Thus by the principal was justified in taking action against Sarah by suspending her and filing the form of student referral (Snyder Swahn, 2016). Other than the test of the objective speaker the court also required that the statement which appears to be a threat should be considered in the light of the facts of the case that surround it. If, the surrounding and statement are such that it is immediate unconditional, specific and unequivocal that the purpose's seriousness is conveyed and that there is a prospect of the statement being carried out in near future, then it would be held to be a true threat (Peterson Skiba, 2001). Thus, in the given case as well considering the history of the student, it can be stated that the threat was a true threat, and any action that may be taken against the student of either suspension or submission of a referral form would be justified legally. Exploring How State of Matter Affects the Rate of Diffusion Essay Introduction Diffusion is the random process by which particles distribute themselves within a container or medium. There are two factors that distinguish how substances move passively through membranes. The first factor is hydrophobic , a nonpolar molecule that can dissolve in a lipid bilayer and freely move through the membrane. However a hydrophillic molecule consisting of ions and polar molecules inhibit in their movement through the membrane making it a slower diffusion process. Selectively permeable, moreover, are charged atoms and molecules that are mostly blocked from traveling through the membrane due to the hydrophobic center. The purpose of this experiment was to test how the state of matter affects the rate of diffusion in a semi-solid vs. a liquid state. If the Potassium Permanganate crystals are placed in Petri dishes filled with water and 2% agar, then the crystals will diffuse at a faster rate in water than in the agar. The addition of the Potassium Permanganate crystals to the water and agar, there will be a result of more diffusion and more obvious color change in water compared to agar which will result in a slower less obvious diffusion. Materials The materials needed for this experiment are: One Petri dish with 2% agar and one Petri dish of water filled half way up to test the rate of diffusion. Also, two small crystals of potassium permanganate and one pair of forceps will be needed to place in the Petri dishes. One metric ruler will be need as well to measure the change of color in diameter and one 8 x 11 piece of white paper will also be used for safety precautions. Methods First, a member of the group will gather all the materials including the Petri dishes filled with tap water and 2% agar, forceps, ruler, 8X11 piece of white paper and the jar that contains the potassium permanganate crystals, and bring the materials back to the designated area. Then the experimenter will start to conduct the experiment. Then the experiment will consist of placing the empty Petri dish and the agar Petri dish on top of the white paper side by side. Second, Tap water will be added to a half way point in the empty Petri dish until it is approximately the same level as agar in the other Petri dish. Before continuing, wait for the water to stop moving to get an accurate measure of the diffusion. After that, have lab partner assist with placing potassium permanganate crystals into the agar Petri dish, while at the same time, the primary experimenter places the other two potassium permanganate crystals into the tap water. Be sure not to splash water in the aqueous dish. The moment that each crystal has been lowered is Time Zero. A purple color will be obvious immediately. Next have the experiment observe the diffusion rate for every 3 minutes for the next 15 minutes. For every 3 minutes, measure the diameter of the diffusion circle in millimeters (mm) and write down the measurement on the chart given. Be careful not to disturb the aqueous Petri dish. Discussion The results show that there a major difference in the rate of diffusion between 2% agar and tap water. Immediately, when the potassium permanganate crystals were dropped at 0, there was already an instant diffusion of 2 mm, compared to agar which was 1mm. Because water is a polar molecule, diffusion across membranes travel quicker compared to a nonpolar substance like agar that diffuse though the lipid part of a membrane. At the first 3 minute mark, it shows that the crystals have diffused relatively fast at 15 mm, compared to the diameter in agar which has slowly diffused to 5 mm. for the next 12 minutes, results have show that the diameter in water has increase about 8 10 mm every 3 minutes and agar has stayed the same throughout. Due to passive transport, the movement of molecules from the potassium permanganate have a higher concentration, and are then added to water which diffuses from that high concentration to a lower concentration. This was the expected result. Since water is polar, the crystals can easily diffuse through the gradient. Furthermore, with agar being a nonpolar molecule, it maintained a state of dynamic equilibrium because it diffused slower but was diffused evenly. However since other factors do play a role in the rate of diffusion, maybe temperature could have changed the rate of diffusion for the two Petri dishes. Also had the allotted time been different there may have also been a change in the results. There were no negative results or errors made during this experiment. Based on the results it can be concluded that dropping potassium permanganate crystals into water, diffuses across the gradient faster compared to 2% agar. This does support the initial hypothesis and the predictions were accurate.
